These Terms of Service ("Terms") govern your use of Yako, an audio news service operated by Proof of Sport LLC ("Yako," "we," "us," or "our"), a Delaware limited liability company based in Santa Barbara, California. By using Yako, you agree to these Terms.
You must be at least 13 years old to use Yako. By using the service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
Yako uses magic link authentication. You are responsible for maintaining the security of the email address associated with your account. Do not share access to your email inbox with anyone you would not want to have access to your Yako account.
You agree to provide accurate information and to update it if it changes. You are responsible for all activity that occurs under your account.
Yako delivers short audio briefings ("clips") that summarize, describe, and comment on content from third-party podcasts, shows, creators, and news sources. These briefings are prepared by our editorial workflow, which may include AI-assisted summarization and synthesized audio narration.
Yako does not reproduce substantial portions of third-party audio. Briefings are original summaries and commentary. We believe this use qualifies as fair use or comparable exceptions under applicable law.
When using Yako, you agree not to:
Yako, including its software, design, branding, and original content, is owned by Proof of Sport LLC and is protected by copyright, trademark, and other intellectual property laws.
We grant you a personal, non-transferable, non-exclusive license to use Yako for your own non-commercial purposes. You may not sublicense, sell, or commercially exploit any part of the service.
Third-party trademarks, source names, and creator names referenced within Yako belong to their respective owners. Reference to these names does not imply endorsement or affiliation.
Yako makes reasonable efforts to present accurate information, but the service is provided for informational purposes only. Briefings are summaries and interpretations, not verbatim transcriptions. We do not guarantee the accuracy, completeness, or reliability of any clip or feature.
You are responsible for verifying any information before acting on it. Yako is not a substitute for professional advice (legal, medical, financial, or otherwise).
Yako references, summarizes, and links to content from third-party creators and publishers. We are not responsible for the content, accuracy, or practices of these third parties. Inclusion of a source on Yako does not imply endorsement of that source's views.
Yako is currently provided free of charge. We reserve the right to introduce paid features or plans in the future. If we do, we will provide clear notice before any charges apply.
We strive to keep Yako available and functioning, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time, with or without notice.
You may stop using Yako at any time. You may request account deletion by contacting privacy@yakonews.com.
We reserve the right to suspend or terminate your access to Yako if you violate these Terms or if we believe your account poses a security or legal risk.
Yako is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Proof of Sport LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of Yako.
Our total liability to you for any claim arising out of or related to these Terms or your use of Yako will not exceed one hundred US dollars ($100.00).
You agree to indemnify and hold harmless Proof of Sport LLC from any claims, damages, or expenses arising from your use of Yako or your violation of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app. Your continued use of Yako after changes take effect constitutes your acceptance of the revised Terms.
